THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5229 of 2018 ORDER:

This Writ Petition is filed challenging the notice dated 09.02.2018 issued by the third respondent under Section 6 of the Andhra Pradesh Land Encroachment Act, 1905. Since the impugned order is passed under Section 6 of the Andhra Pradesh Land Encroachment Act, there is a provision for appeal against the said order. Learned Counsel for the petitioner submits that the impugned order was passed without hearing and without giving an opportunity to the petitioner. In the circumstances, there shall be status quo with regard to the possession for a period of thirty days. In the meanwhile, the petitioner can invoke the remedy of appeal. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in Writ Petition, if any, shall stand closed.
