HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40058 of 2016 ORDER:

This writ petition is filed by the petitioner seeking to declare the action of respondents Nos.1 to 3 in not conducting an enquiry against respondents Nos.4 to 7 by considering the representations of the petitioner in respect of the land of the 6th respondent-temple, as illegal and arbitrary. 2.

It is stated in the affidavit that the petitioner is the devotee of the 6th respondent-temple viz., Sri Ananthapadmanbhaswamy Vari Temple. The land of an extent of Ac.7.43 cents in Sy.No.30 situated in Padmanbham village and Mandal, Visakhapatnam District belongs to the said temple. The 9th respondent sold some portion of the land belonged to the temple to the 8th respondent, claiming it as his property. Aggrieved over the same, the petitioner addressed a letter to the 2nd respondent-Commissioner, Endowments Department, and the said representation is pending. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"The 2nd respondent is directed to consider the representation of the petitioner and dispose of the same in accordance with law, as expeditiously as possible." No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
