These Criminal Petitions, under Section 438 of the Code of Criminal Procedure, 1973, are filed by the petitioner, for grant of anticipatory bail in Crime No.158 of 2018 of Mallial Police Station, Jagtial District and in Crime No.221 of 2018 of Jagtial (Rural) Police Station, Jagitial District, respectively registered for the offence punishable under Section 420 read with 34 of IPC. 2.

Heard the learned counsel for the petitioner, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is not responsible for the alleged offence. Earlier, a case was registered against the petitioner herein in Crime No.118 of 2018 of Mallial Police Station, Jagtial District, wherein it has come to light that the de facto complainant herein was the victim therein and the petitioner was granted bail in the said crime and ultimately, prayed to allow the petitions.

Learned Additional Public Prosecutor representing the respondent/ State opposed the grant of bails to the petitioner and ultimately prayed to dismiss the petitions.

As per the FIRs lodged in the subject crimes, the allegations made against the petitioner are with regard to taking of amount of Rs.3,50,000/ - and Rs.3,00,000/ - respectively from the de facto complainants in order to procure jobs to them as police constables.

It appears from the record, the cause of action in the two cases is distinct. There is nothing wrong in the registration of crimes and proceeding with the investigation. The allegations made against the petitioner are of serious in nature i.e., cheating the unemployees under the guise of procuring employment as police constables and collecting huge money from them. The matter requires thorough investigation. There is stringent punishment for the offence alleged. Therefore, it is not appropriate to allow the petitions under Section 438 Cr.P.C. 7.
