THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.1900 OF 2018 ORDER:

Heard learned counsel for the petitioners/A.4 to A.6, learned Additional Public Prosecutor for respondent State and perused the record.

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.234 of 2017 of Parigi Police Station, Vikarabad District.

Learned counsel for the petitioners/A.4 to A.6 would submit that the petitioners have nothing to do with the alleged theft of cotton. There is a dispute between respondent No.2 and A.2 with regard to the land. Respondent No.2 succeeded in the suit. As seen from the record, the value of the cotton is Rs.5,000/-. Under these circumstances, there are no grounds to quash the proceedings in this crime against the petitioners/A.4 to A.6, but a direction can be given to the Station House Officer. The Station House Officer concerned shall complete the investigation in this case and file final report without arresting the petitioners/A.4 to A.6.

With the above direction, the Criminal Petition is dismissed. The Miscellaneous Petitions, if any, pending shall stand closed.
