HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6390 of 2019 ORDER:

This Writ Petition is being disposed of at the admission stage with the consent of both the parties.

This Writ Petition is filed seeking Writ of Mandamus declaring the action of the second respondent in not passing any orders on the application dated 27.02.1979, filed by the mother of the petitioner and the application submitted by the petitioner on 05.01.1998 to appoint him on compassionate grounds, inspite of repeated requests, as arbitrary, illegal and sought a consequential direction to the second respondent to appoint the petitioner on compassionate grounds, in any suitable post.

Heard Sri Amin Ali Allauddin, learned counsel for the petitioner and learned Government Pleader for Services - II. It has been contended by the petitioner that his father was an employee with the respondents and the father of the petitioner expired on 22.12.1978, while discharging his duties. The petitioner further submits that at the time of death of his father, the petitioner was a minor and his mother has submitted an application on 27.02.1979 requesting to consider the case of the petitioner for appointment on compassionate grounds. The petitioner further respectfully submits that the petitioner has attained majority during the year 1994 and on attaining the age of majority, he submitted another application seeking compassionate appointment. The grievance of the petitioner is that though for more than three decades, he and his mother have been submitting representations requesting the respondents to consider his case for compassionate appointment, the respondents have not passed any

orders on the application preferred by him. Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the Writ Petition directing the respondents to pass appropriate orders on the application submitted by the petitioner's mother on 27.02.1979 and by him on 05.01.1998. The learned Government Pleader appearing for respondents submits that the case of the petitioner would be considered and appropriate orders would be passed, in accordance with law. Having considered the above submissions made, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 05.01.1998 and pass appropriate orders in accordance with law, within eight weeks from the date of receipt of a copy of this order. No costs. Consequently, Miscellaneous Petitions, if any, pending shall stand closed.
