THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 237 OF 2017 O R D E R:

This contempt case is filed alleging non-implementation of the order, dated 28.10.2016, passed by this Court in W.P.No.36887 of 2016.

Respondent No.1 filed a counter-affidavit asserting that action has been taken against respondent No.4 in the writ petition with respect to the violations, by duly following the procedure prescribed under the Greater Hyderabad Municipal Corporation Act. He filed photographs in proof of the same. Today, when the matter is taken up, there is no representation on behalf of the petitioner.

Though a copy of the counter-affidavit has been served, the petitioner has not filed reply-affidavit refuting the specific assertions mentioned in the counter-affidavit. In those circumstances, taking into consideration the specific assertions mentioned in the counter-affidavit and there being no denial of the same, this Court is satisfied that the order of this Court has been complied with in its letter and spirit. The contempt case is accordingly closed.

Consequently, miscellaneous applications, if any shall stand closed.
