THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.1606 OF 2006 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ , Order, or Direction, more particularly one in the nature of Writ of MANDAMUS to consider and dispose of the Representations of the Petitioner dt.16-1-2006 pertaining to the Caste Certificate in terms of The Andhra Pradesh (Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993 & Rules 1997 and take appropriate action as per the Act and Rules Consequently declare the inaction of the Respondents in taking action in pursuance of the representations of the petitioner as bad in law and violative of the Act 16 of 1993 and The Andhra Pradesh (Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Rules 1997, in the Interest of Justice and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

2. Heard Sri B.Sudhakar Reddy, learned counsel, appearing for the petitioner and learned Government Pleaders for Home and Revenue, appearing for respondents 1 and 2. Despite service of notice, none appears for the 3rd respondent.

Disputing the social status certificate said to have been obtained by the 3rd respondent and praying for appropriate action against the 3rd respondent, the petitioner herein said to have submitted a representation dated 16.01.2006 to the respondents. The grievance of the petitioner in the present writ petition is inaction on the part of the respondents in taking action on the said representation. This Court, as long back as on 10.04.2006, admitted the Writ Petition and issued notices. Despite service of notice, no counter affidavits have been filed by the respondents.

4. In these circumstances, this Court deems it appropriate to dispose of the Writ Petition by directing the respondents 1 and 2 to take appropriate action on the

representation said to have been submitted by the petitioner on 16.01.2006 by fixing some timeframe.

5. For the aforesaid reasons, writ petition is disposed of, directing the respondents 1 and 2 to take appropriate action on the representation dated 16.01.2006 said to have been submitted by the petitioner herein, if not already disposed of, within a period of three months from the date of receipt of a copy of this order.
