THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6374 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents in considering the application dated 25.2.2019 filed for non-incorporating all the lands in survey No.575 extent Ac 0.05 gts, in Survey No.588 extent Ac 0.02 gts and in Survey No.589 extent Ac 0.06 and incorporating the lands in survey No.524 only 0.07 gts out of Ac 0.16 in Survey No.590 only 0.01050 gts out of 0.12 gts and in survey No.603 only extent 2.00 gts out of 2.

01 gts situated at Ammapur village, Narmetta Mandal, Janagam, in new pass books even though these lands are included in the old pass books as arbitrary and illegal and contrary to the provisions of Telangana Rights in Lands and Pattedar Pass Books Act 1971 and rules framed thereunder and also violative of Article 16 and 300A of constitution of India consequently direct the respondents to consider the application dated 25.2.2019 and rectify all the survey numbers and extents in new pass book issued vide Khata No.465 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

Perusal of the record reflects that the petitioner was earlier issued a regular pattadar pass book under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, detailing his land holdings in various survey numbers of Ammapur Village, Narmetta Mandal, Janagam District. However, when he was issued a new pattadar pass book in keeping with the Government's policy, the land holdings were vastly reduced therein. He submitted an application on 25.02.2019 to the

Tahsildar, Narmetta Mandal, Janagam District, seeking rectification of the entries in the new pattadar pass book.

Perusal of the application dated 25.02.2019 bears out that it was received by the office of the Tahsildar concerned on the very same day. Having received such an application, it is not open to the Tahsildar, Narmetta Mandal, to remain somnolent.

The writ petition is accordingly disposed of directing the Tahsildar, Narmetta Mandal, Janagam District, to take appropriate action upon the petitioner's application dated 25.02.2019 in accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
