THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR Contempt Case No. 172 of 2016 JUDGMENT:

This contempt case is filed praying to punish the Respondent for not implementing the orders passed by this Court dated 12.11.2015 in WPMP No.41739 of 2015 in W.P.No.32301 of 2015, and to direct the Respondent to comply with the said orders immediately.

The above WPMP was filed by the petitioner seeking a direction to the 3rd respondent to remove the seal put on the petitioner's bore-well situated at Sy.No.285 of Amelepalle village, Gurramkonda mandal, Chittoor district.

On 12.11.2015, while ordering notice to the respondents, this Court, prima facie, found that the action of the Tahasildar, respondent herein, is without jurisdiction, since the power to order closure of bore-wells vests with the 'Authority', as defined under Sec.2(1) of the A.P.Water, Land and Trees Act, 2002, and that there is a distinction between the 'Authority' and 'Tahsildar', and therefore granted interim suspension against the impugned action of the Respondent herein.

However, today when the matter is taken up for hearing, the learned Assistant Government Pleader for Revenue (AP) would submit that the seal of the bore-well has been removed and it is being put to use of public at large.

In view of the above, the order of this Court dated 12.11.2015, passed in the above petition, is deemed to be complied with. Hence, no further orders are necessary to be passed in this contempt case.

Accordingly, the contempt case is closed. As a sequel, the miscellaneous petitions, if any pending, shall stand closed accordingly.
