HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.5234 of 2018 ORDER:

The petitioner prays for the following relief :- " ...... to issue writ or direction preferably Writ of Mandamus declaring the action of the 4th respondent in issuing public notification vide R.C.No.159/ 2018 dt 1-2- 2018 inviting applications for appointment of FP Shop No.15, Nidiguntapalem Village Venkatachalam Mandal of SPSR Nellore Dist., despite pendency of revision filed along with stay petition before the 2nd respondent on 9-5-2016 as illegal arbitrary and violative of principles of natural justice and consequently set aside the notification dt 1-2-2018 by directing the 4th respondent not to issue any further notification till the dispose of revision by the 2nd respondent and dispose of the stay petition or revision itself within a reasonable time....".

The petitioner aggrieved by the order of appellate authority filed revision before the 2nd respondent and the revision is taken on file as Case No.Rc.E.191/ 2016.

Mr.Srinivasa Rao learned counsel for petitioner submits that the revision was heard on 20.08.2016 and no order is passed and no steps are under way to fill up the vacancy, for which the petitioner was appointed as Fair Price Shop Dealer on regular basis. Therefore, the challenge, as noted above.

I have heard the counsel for petitioner and the Assistant Government Pleader for Civil Supplies.

This Court, after taking note of totality of circumstances particularly the ground on which the challenge to Notification dated 01.02.2018 is made, is of the view that the writ can be disposed of by directing the 2nd respondent to positively pass orders in File No.Rc.E.191/ 2016 within two weeks from today. The Assistant Government Pleader, who opposed granting any interim order, is given liberty to communicate this order to 2nd respondent forthwith.

The writ petition is disposed of accordingly. No order as to costs.
