THE HONOURABLE Dr.JUSTICE G. RADHA RANI CRIMINAL PETITION No.2712 of 2024 ORDER:
This Criminal Petition is filed by the petitioner - Accused No.2 under Section 438 of Code of Criminal Procedure to enlarge her on anticipatory bail in the event of her arrest in connection with Crime No.77 of 2024 of Siricilla Police Station, Rajanna Siricilla District, registered for the offence under Section 304-B IPC.

The case of the prosecution in brief was that on 07.02.2024 at 11.00 hours, the de-facto complainant, father of the deceased, lodged a report before the Police, Siricilla, stating that due to the harassment of her husband and mother-in-law demanding additional dowry of Rs.10.00 lakhs, his daughter vexed up with her life committed suicide by consuming some unknown poison and died at 16.00 hours on 06.02.2024. A1 was arrested on 08.02.2024. Basing on the said report, the above crime was registered for the above offence.

Heard Sri T. Surya Satish, learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner was a resident of Laxmannapalli, H/o.Ellanthakunta Village and Mandal of Karimnagar District, her son A1 and her daughter-in-law, the deceased were residing at Siricilla, which was 100 kms., away from the place of the petitioner. A1 was the only son of the petitioner and he was working as a Constable. The parents of the deceased demanded the accused to register immovable properties in the names of the minor children and in that regard, disputes were going on between A1 and his wife and due to which she consumed some unknown poison. He further submitted that the husband of the petitioner-A2 was suffering with cancer and the petitioner had also underwent cataract surgery for both the eyes and requested for grant of anticipatory bail to the petitioner.

Learned Assistant Public Prosecutor opposed grant of anticipatory bail to the petitioner stating that specific allegations were made against the petitioner in the complaint lodged by the de facto complainant. 6.
Perused the record. Considering the submissions of the learned counsel for the petitioner - A2 that the petitioner was residing at Laxmannapalli, H/o. Ellanthakunta Village and Mandal of Karimnagar with her husband and filed Aadhar card of the petitioner in proof of the same and even as per the complaint, A1 along with his family was residing at Siricilla
Dr.GRR, J Crl.P. No.2712 of 2024 due to his employment for the past six years and also considering that the petitioner is a woman, it is considered fit to grant anticipatory bail to the petitioner on certain conditions.

In the result, the Criminal Petition is allowed and the petitioner - A2 is granted anticipatory bail subject to the following conditions: (i) The petitioner - A2 is directed to surrender before the Station House Officer of Sircilla Police Station, Rajanna Siricilla District, within a period of (15) days from the date of this order, and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for the like sum each to the satisfaction of the said Station House Officer.
(ii) The petitioner - A2 shall comply with all the conditions stipulated under Section 438(2) of Cr.P.C. As a sequel, miscellaneous applications pending in this petition, if any shall stand closed.
