O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.129 of 2026 of Uppal Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 69 of the BNS.

The case of the prosecution is that, on 26.10.2025, the de-facto complainant lodged a report before the police stating that one year back she met the petitioner herein and two months later he proposed his love and she accepted after 2 months, he used to say that he will marry her by convincing her parents and he used to frequently visit her hostel in Medipally. In August he came to her hostel and said that he is feeling sleepy and took her to OYO Room, Uppal and they met Physically there, in 6 months they met Physically 2-3 times in Sridhar's friends room and later the petitioner started avoiding her and said that he doesn't like her and doesn't want to marry her and don't harass him by saying that her character is bad and cheap and blocked her numbers. He cheated her by saying that he will marry her and used her physically. Later she came to know from the petitioner's friends that he cheated many girls in name of love. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri N. Narsimulu, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy,

- 3 - learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and there is no such incident occurred and whatever the relationship between them is a consensual relationship and the de-facto complainant also filed a memo stating that she has no objection to grant bail to the petitioner and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner herein are heinous in nature, as such, at this stage, he is not entitled for the bail and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since

- 4 - 05.02.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 14 have already been examined. Further, the de-facto complainant has filed a memo stating that she has no objection to grant bail to the petitioner. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties for a like sum each to the satisfaction of learned VI Additional Metropolitan Magistrate Court, Medchal-Malkajgiri District, Uppal at Medipally.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever

- 5 - is earlier, for purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed..
