HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.5162 of 2015 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise appearing for the respondents.

Petitioner states that his vehicle TATA ACE MAGIC bearing No.AP 9 VR/TGR 0361 was seized by the third respondent on 04.09.2013 on the alleged ground of its involvement in an offence of excise under A.P.Excise Act in Crime No.170 of 2013 and the vehicle is stated to be deposited with the second respondent on 07.02.2015. Petitioner states that he is totally unconnected with the said alleged offence and there is no evidence to implicate him or the vehicle in the said offence. He however sought release of the said vehicle on the ground that it is lying under seizure from 04.09.2013. He however appears to have made an application seeking release on 07.02.2015 and it is stated to be pending before the second respondent, alleging that no orders were passed on the said application and apprehending damage to the vehicle on account of its continuous seizure from 04.09.2013, the present writ petition is filed.

Though the vehicle which is said to have been seized on 03.09.2013, petitioner moved the application seeking release only on 07.02.2015 and not before that date.

Even otherwise, approximately three weeks have already been expired from the date of his application. Hence, it is appropriate that the second respondent shall consider the said application and pas appropriate orders there on within a week from the date of receipt of a copy of

this order.

Accordingly, writ petition is disposed of. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
