THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1913 of 2014 ORDER:
The respondent-contemnor is present in Court today. The order, violation of which is alleged in this Contempt Case, was passed in W.P.No.29469 of 2011 dated 11.11.2011 whereby the petitioners' application dated 25.07.2011, for issuance of pattadar pass books and title deeds, was directed to be considered in accordance with law after complying with the provisions of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 and the Rules made thereunder. An order was directed to be passed within a period of two months from the date of the order. The two month period, stipulated in the order passed by this Court, expired on 11.01.2012. The fact, however, remains that an order came to be passed only on 02.12.2014, nearly three years after the time stipulated by this Court had expired. While the delay is no doubt inordinate, and the explanation furnished in this regard may not justify the unduly belated compliance with the order of this Court, the respondent-contemnor has tendered his unconditional apology for the delay in implementing the order of this Court.
Learned Government Pleader for Revenue would submit that the respondent-contemnor, who is present in Court, expresses his sincere regret, and tenders his unconditional apology, for the belated compliance; and assures this Court that he would, henceforth, ensure compliance of the orders of the Court within the stipulated time.
In the light of the unconditional apology tendered by the respondent-contemnor, and as it does appear that the expression of regret by the respondent-contemnor, for the belated compliance of the order of this Court, is genuine, I see no reason to proceed against him under the Contempt of Courts Act or to punish him for contempt.
The Contempt Case is, accordingly, closed.
The miscellaneous petitions, if any pending, shall also stand closed. There shall be no order as to costs.
