THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION No.6492 OF 2016 ORDER:

The petitioners - A1 to A5, who were arrested by the police of III Town (Law and Order) Police Station, Rajamahendravaram Police Station, in Crime No.152 of 2016 for the offences punishable under Section 8 (a) (c) read with 20 (b) (ii) (C) of Nacrotic Drugs and Psychotropic Substances Act, 1985, for transporting contraband ganja of 1160 Kgs. and Rs.70,000/-, all worth Rs.20,00,000/-, filed the instant bail application. Heard.

Learned counsel for the petitioners seeks bail on the ground that A7 and A8 were granted bail in Crl.P.No.7188 of 2016 by this Court as per order, dated 12.05.2016 and considering the case of the petitioners on same footing, bail may be granted to them.

It is seen that the contraband ganja was seized from the possession of the petitioners - A1 to A5 and hence, there is a prima facie involvement of the petitioners in the offence, whereas A7 and A8 were charged only on the alleged confessional statement of A1 to A5. Therefore, the bail granted to A7 and A8 is of no avail to the petitioners.

Having regard to the gravity and magnitude of the offence and its impact on the society and also considering that the contraband ganja seized is of

commercial quantity and investigation being pending, bail is refused to the petitioners.

Accordingly, the petition is dismissed.
