THE HON'BLE T. AMARNATH GOUD WRI T PETI TI ON No. 12387 of 2007 ORDER:

This writ petition is filed by the petitioners to declare the action of the respondents in seeking to grant house site pattas in the canal/tank poramboke land in an extent of Ac.0.45 cents in Survey Nos.236, 237 and 258 situated at Samathanagar, Akiveedu Village and Mandal, West Godavari District, as arbitrary, illegal and contrary to law.

According to the petitioners, they are having Ac.0.30 cents, Ac.0.27 cents, Ac.0.33 cents and Ac.0.30 cents of land respectively in Survey No.256/3 situated at Samathanagar, Akiveedu Village and Mandal, West Godavari District. They are using the land, which is sought to be assigned for house sites, for the purpose of ingress and egress to their land for carrying out agricultural operations. When respondents 3 and 4 started taking the measurements of the subject land for the purpose of providing house sites, the petitioners made representations to the Revenue and Irrigation authorities on 02.06.2007. As no action has been taken on the said representation, the petitioners filed the present writ petition. This Court, while admitting the writ petition, on 18.06.2007, granted interim direction as prayed for.

A counter affidavit has been filed by the fourth respondent stating that it is only under apprehension the petitioners have approached this Court; that no house sites are being assigned in

Survey Nos.236 and 237 and that the petitioners' interest will be taken care of while assigning the land for house sites. Recording the aforestated counter affidavit averments, and as the petitioners filed this writ petition on apprehension, the writ petition is disposed of.

Interim order, dated 18.06.2007, shall stand vacated.

Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
