HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No.852 of 2010 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Crime No.420 of 2009 on the file of Nandigama Police Station for the offences punishable under Sections 406, 420, 468 and 471 IPC.
When the matter is taken up for hearing, there is no representation for the petitioner. However, learned counsel representing the learned Public Prosecutor states that the present Criminal Petition was filed seeking to quash the proceedings in Crime No.420 of 2009 on the file of Nandigama Police Station and that after completion of investigation, a charge sheet was filed and after conclusion of trial, the petitioners/accused 1 and 2 were acquitted for the offences alleged.
In that view of the matter, recording the said submission, nothing further remains to be adjudicated in the Criminal Petition and the same is liable to be dismissed.
Accordingly, the Criminal Petition is dismissed for nonprosecution. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
