HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.37848 of 2015 O R D E R :

The petitioners have filed this writ petition questioning the proposed action of respondent Nos.2 to 5 to establish a Rythu Bazar in an extent of 882 square yards in Sy.No.287, converted as T.S.No.1740 of extension Ward No.18, Block No.22 of Gujjanagundla, Guntur District, alleging that the said land is classified as a tank.

2. The learned Government Pleader for Agriculture, on instructions, states that the 5th respondent-Agriculture Market Committee had not filed any representation for allotment of the above land for establishing Rythu Bazar and even the Revenue authorities have not sanctioned any type of allotment or handed over advance possession of this land to anybody as on date.

3. In view of the said submission, there is no cause of action for the petitioners to pursue the writ petition.

4. Therefore, this writ petition is dismissed, giving liberty to the petitioners to again approach this Court, in case the land mentioned above is sought to be allotted for Rythu Bazar, at the instance of the 5th respondent-Agriculture Market Committee. Interim order granted by this Court on 20.11.2015 is vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
