V.Pavan Kumar, v. G.Mallikharjuna Prasad,
HON'BLE SRI JUSTICE R.KANTHA RAO Contempt Case No.786 of 2014 Judgment:
Heard Sri V.V.N. Narasimham, learned counsel appearing for the petitioner and Sri K.V.N. Bhupal, learned counsel appearing for the respondents 1 and 2.
2. The 2nd respondent-contemnor is present. He filed an Affidavit tendering unconditional apology for violating the orders of this Court dated 22-4-2014 in W.P.No.12322 of 2014 by conducting a public auction on 22-4-2014. It is further stated by the contemnor that he got the impugned Notification cancelled by proceedings dated 21-8-2015 publishing in Andhra Bhoomi Telugu Daily, Kadapa edition. The contemnor initially filed counter stating that he has not violated the orders of this Court, but now he filed the Affidavit tendering unconditional apology stating that he will not repeat this type of conduct in future.
3. Though this Court is of the view that the 2nd respondent-contemnor violated the orders passed by this Court deliberately, as unconditional apology is followed by the cancellation of the earlier Auction Notification, the contempt case is closed. The applications, if any, pending in this contempt case shall stand closed.
