THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.5341 OF 2018 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of Writ of Manadamus declaring the action of the respondent bank in not considering petitioner's request for One-Time Settlement of his loan account bearing No 732261530 inspire of my letters dated 14.06.2017 and 05.02.2018, as illegal, arbitrary and unconstitutional and consequently direct the respondent to consider the case of petitioner for One-Time Settlement as per the prevailing scheme announced by the respondent bank by considering the representations of the petitioner dated 14.06.2017 and 05.02.2018 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'
Sri Ambadipudi Satyanarayana, learned counsel for the Indian Bank, having received instructions, would inform this Court that there is no One Time Settlement scheme available as on date, whereby the petitioner could seek benefit thereunder.
In that view of the matter, we are of the opinion that no direction can be given to the respondent bank to evolve a One Time Settlement scheme for the benefit of the petitioner alone. It would be open to the petitioner to avail the benefit of a scheme as and when it is floated by the bank, provided he is eligible to do so.
The writ petition is accordingly dismissed subject to the above observation.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
