THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed for the following substantive relief: "... to issue an order, direction or a writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not receiving the applications of the petitioners to admit them as members of Tada Primary Agricultural Cooperative Credit Society Ltd., Tada, Tada Mandal, SPSR Nellore District, as illegal, arbitrary, violative of Articles 14 and 21 of the Constitution of India and contrary to the provisions of the A.P. Cooperative Societies Act, 1964 and the Rules made thereunder the Act and consequently

direct the respondent Nos.3 and 4 to receive the applications of the petitioners and admit them as members of the Tada Primary Agricultural Cooperative Credit Society Ltd., Tada, Tada Mandal, SPSR Nellore District, (4th respondent society) with effect from 21.12.2012 and allot Account No/Membership No. and include them in the voters' list of Tada Primary Agricultural Cooperative Credit Society Ltd., Tada, Tada Mandal, SPSR Nellore District, so as to enable them to participate in the ensuing elections of the 4th respondent society." At the hearing, Mr. V. Sudhakar Reddy, learned counsel for the petitioners, submitted that as elections to respondent No.4 - Society were already held, the cause of action in the writ petition does not survive for adjudication. In view of the above submission, the writ petition is dismissed as infructuous. As a sequel to dismissal of the writ petition, W.P.M.P. No.50188 of 2012 shall stand disposed of as infructuous.
