HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.32525 of 2015 Order: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Sri Ch. Ravinder, learned counsel for the petitioner and Sri Taddi Nageswara Rao for respondent No.2. None appears for the contesting respondent No.3.
The petitioner was admitted to M.B.B.S. course from 'B' category. She had furnished bank guarantee for tuition fee chargeable for the entire course. Thereafter, she approached this Court seeking withdrawal of the first bank guarantee and to permit her to furnish bank guarantee for one year. She made such prayer in view of the subsequent G.O.Ms.No.73, dated 26.08.2015, issued by the Government.
Similar prayer was made in W.P.No.26906 of 2015 and it was granted by a Division Bench of this Court vide order, dated 27.08.2015. Learned counsel for the respondents have not opposed the prayer. In view thereof and having considered G.O.Ms.No.73, we dispose of this writ petition by the following order:
"Admittedly, the petitioner has not furnished bank guarantee for one succeeding year so far. In view thereof, the petitioner is directed to furnish a bank guarantee for the succeeding year 2016-17 and on furnishing of the bank guarantee, respondent-college authorities shall
return the bank guarantee of Rs.36.00 lakhs, which was furnished covering the fees for all four years in August, 2015, within a period of three weeks from today. Petitioner to furnish undertaking to this Court within a period of three weeks from today that she shall renew the bank guarantee from time to time for every succeeding year. It is needless to mention that petitioner shall forward a copy of the undertaking to respondent No.3."
Miscellaneous petitions, if any, shall also stand disposed of. No costs.
