THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.1287 of 2016 ORDER:

Petitioner has filed this Contempt Case alleging violation of the order dt.22-03-2016 in W.P.M.P.No.11760 of 2016 in W.P.No.9280 of 2016.

In the said order, this Court has directed both parties to maintain status quo with regard to the subject land pending disposal of the Writ Petition.

Learned Government Pleader for Assignment has filed a counter-affidavit stating that on 03-09-2015 patta issued to the petitioner was cancelled by the Joint Collector, Y.S.R. Kadapa District and that the land allotted to petitioner was resumed under a panchanama on 23-01-2016.

Though petitioner alleges that when she went to the land on 02-04-2016 and wanted to draw water in the mango trees raised by her in the land, she was not allowed to do so by respondents and this amounts to violation of the order passed by this Court on 22-03-2016, since the petitioner was not in possession after cancellation of her patta and taking over of her land on 23-01-2016 itself, it cannot be said that the respondents have violated the status quo order passed by this Court. In the counter-affidavit, it is specifically stated that ever since resumption of the land, the land and trees existing on the ground are being protected and trees are being duly watered.

Therefore, I do not find any merit in the Contempt Case and it is accordingly closed. No costs.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
