THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6401 OF 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the Respondents in not considering the application of the Petitioner dated 27.12.2018 seeking refund of Rs.1,20,001/ as illegal arbitrary and unconstitutional and against the principals of natural justice and pass such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

It is the case of the petitioner that she deposited the subject amount of Rs.1,20,001/- in the wrong Head of Account. She made representation dated 27.12.2018 in this regard to the District Registrar, Red Hills, Hyderabad, seeking refund of this amount. The endorsement made on the said representation bears out that the office of the District Registrar, Red Hills, Hyderabad, received it on the very same day. Having received such an application, it is not open to the District Registrar, Red Hills, Hyderabad, to remain somnolent. The Writ Petition is accordingly disposed of directing the District Registrar, Red Hills, Hyderabad, to take appropriate action upon the petitioner's representation dated 27.12.2018 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
