HON'BLE SRI JUSTICE S.V.BHATT W.P.No.14326 OF 2014 ORDER:

The petitioners pray for the following relief: ....this Hon'ble court may be pleased to issue a writ, order or orders specially one in the nature of writ of Mandamus declaring the action of the 3rd and 4th respondents in sending the labour and interfering our possession of the lands in an extent of Ac.0-50, Ac.0-54, Ac.0-42, Ac.0-43, Ac.0-42 and Ac.0-43 cents S.No.46/1 of Nandamuru Village, Tadepalligudem Rural Mandal, West Godavari District pending the land acquisition proceedings initiated under the L.A. Act, 1894 (repealed) without passing any award either under the L.A. Act, 1894 or under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 is illegal, arbitrary and violative of Art.300-A of the Constitution of India and consequently direct the 3rd and 4th respondents to not to interfere with the lands in S.No.46/1 of Nandamuru Village and pass.............

This Court, on 08.05.2014, granted stay of dispossession of petitioners from the land under acquisition. The same is subsisting as on date.

Learned Government Pleader for Land Ac quisition, on instructions, submits that on 21.05.2015, Award has been passed under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30/ 2013) and compensation will be paid according to Act 30/ 2013. Mr.S.Subba Reddy appearing for petitioners submits that he has no instructions whether the copy of the Award has been served or not and requests the Court to direct respondents to serve copy of

the Award to the petitioners. Therefore, if the respondents have not communicated/ served Award on the petitioners, the respondents shall serve or communicate the award to the petitioners within a period of four weeks from today. The request of counsel for petitioners is accepted and the respondents are accordingly to do the needful.

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
