HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 27117 of 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition being heard at the admission stage itself. The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents in forcibly stopping cultivation activities of the petitioner over the agricultural land admeasuring Ac.0.65 cents situated in Sy.No.154/4 of Sarabhavaram Village at Uppayyapalem sub-village of Devipatnam Mandal. Though various grounds are raised, the learned counsel for the petitioner mainly submits that the petitioner may not be dispossessed from the land without following due process of law.

The learned Government Pleader submits that he has no objection for the same provided that the petitioner is still in possession of the land. Having regard to the circumstances stated above and without going into the merits of the case, the writ petition is disposed of directing the respondents not to dispossess the petitioner from the land admeasuring Ac.0.65 cents situated in Sy.No.154/4 of Sarabhavaram Village at Uppayyapalem sub-village of Devipatnam Mandal, without following due process of law, if the petitioner is in possession of the same. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
