This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973, is filed by the petitioner, challenging the order, dated 21.12.2017, passed in Crl.M.P.No.1054 of 2017 in D.V.C.No.4 of 2008 by the II Additional Judicial Magistrate of First Class, Khammam.

Heard the learned counsel for the petitioner. Despite service of notice on respondents 1 to 3, there is no appearance on their behalf. Perused the record.

By docket order, dated 30.01.2018, the Court of Session returned the un-numbered revision filed by the petitioner under Section 397 & 399 of Cr.P.C. Questioning the said order, this Criminal Revision Case is filed. The Court of Session rightly found that the petition is not maintainable. The said finding of the Court of Session is not erroneous. There is nothing to interfere. However, in the circumstances narrated by the learned counsel for the petitioner, the petitioner is given liberty to work out the remedies available to him under Section 29 of The Protection of Women from Domestic Violence Act, 2005.

With the above observation, this Criminal Revision Case is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Revision Case, shall stand closed.
