THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1928 OF 2018 ORDER:

This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.259 of 2017 on the file of the Station House Officer, Chandanagar Police Station, Cyberabad District, which was registered for the offences punishable under Sections 420 and 506 r/w 34 IPC. 2.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that there is no document to show the alleged procurement of Proclainer by this petitioner in favour of the de facto complainant. All the allegations made in the F.I.R. are false. 4.

On the other hand, learned Assistant Public Prosecutor opposed the relief sought for by the petitioner in the petition.

The material on record reveals that the petitionerA1 said to have collected an amount of Rs.10,00,000/- to procure a Proclainer in favour of the de facto complainant. There is no document to show the receipt of money. Now, it is alleged that the de facto complainant gave Rs.10,00,000/- to the petitioner-A1 on 05.02.2017. It is submitted that the S.H.O. has issued a notice under Section 41-A Cr.P.C. In view of the nature of allegations, the truth or otherwise is required to be determined in the course of investigation. Under these circumstances, the S.H.O./Investigating Officer shall complete the investigation of the case and file final report without arresting the petitioner-A1.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
