THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.689 of 2014 O R D E R:

This Contempt Case is filed by the petitioner herein against the respondents alleging willful and deliberate disobedience of the order dt.30.03.2011 in W.P.No.8670 of 2011 passed by this Court restraining the Hyderabad Urban Development Authority, the predecessor of the Hyderabad Metropolitan Development Authority (for short 'the HMDA'), whose Commissioner is the 1st respondent, not to construct any new wall in the place of demolished wall in between Plot Nos.127 and 128.

The respondents filed a counter affidavit denying that HMDA had anything to do with the construction of wall, which is found to be existing by the Advocate-Commissioner appointed by this Court.

Smt K.Savitri, who claims to be the allottee of plot No.128 has filed a counter affidavit in W.P.No.8670 of 2011 stating that she had built the said compound wall, but it is not stated specifically when she built the said compound wall. 4.

Counsel for petitioner is not able to place any material to show that the HMDA is responsible for construction of the compound wall in between Plot Nos.127 and 128.

In this view of the matter, the respondents in the Contempt Case cannot be said to have disobeyed the order dt.30.03.2011 in W.P.No.8670 of 2011.

Therefore, the Contempt Case is dismissed. No costs. 7.

Consequently, miscellaneous petitions pending if any shall stand closed.
