HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.14312 of 2016 ORDER :

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioners/A1 to A18 seeking to quash the order dated 20.08.2016 passed by the I Additional Sessions Judge, Adilabad, Adilabad District in Crl.M.P. CFR No.523 of 2016 in S.C.No.102 of 2012.

The grievance of the petitioners is that the trial Court returned the petition filed under Section 173(8) of Cr.P.C to direct the police to submit an additional or supplementary charge sheet or report by making impartial immediate further investigation in Crime No.126 of 2008 of Bhainsa Town Police Station, Adilabad without being numbered.

Heard learned counsel for petitioners and the learned Public Prosecutor and perused the material available on record.

In view of the facts and circumstances of the case and taking into consideration of the submission of learned counsel for the petitioners, the Criminal Petition is disposed of, directing the Court below to number Crl.M.P. CFR No.523 of 2016 in S.C.No.102 of 2012, issue notice to the other side and dispose of the same on merits after hearing both sides. Office to return the original papers, if any, filed by the petitioners.
