THE HONOURABLE SRI JUSTICE K. LAKSHMAN WRIT PETITION No.7179 of 2021 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondent No.3 in not providing the police protection/aid to the property of the petitioner i.e., agricultural land to an extent of Ac.3-06 guntas in Survey No.868/2, situated at Papakollu Village, Jullurpadu Mandal, Bhadradri Kothagudem Disrict, by considering the orders passed by the learned Sub-Divisional Magistrate & Special Assistant Agent, Mobile Court, Bhadrachalam, in I.A.No.659 of 2020 in I.A.No.32 of 2020 in O.S.No.30 of 2020, dated 15.12.2020, as arbitrary and illegal and consequently, to direct respondent Nos.2 and 3 to provide police protection/aid to the petitioner and his property mentioned above.

Heard Sri Challa Srinivasa Reddy, learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for the official respondents. Perused the record. 3.

A perusal of material paper would reveal that the Special Assistant Agent and Sub-Divisional Magistrate, Mobile Court. Bhadrachalam, vide order, dated 15.12.2020 in I.A.No.659 of 2020 in I.A.No.32 of 2020 in O.S.No.30 of 2020, directed respondent No.3 to provide police protection/aid to the petitioner herein in respect of the subject property. Despite the petitioner submitting an application along with a copy of said order, dated 15.12.2020, respondent No.3 has not acted upon the said application. Therefore, the present Writ Petition is filed.

According to the learned counsel for the petitioner, the order, dated 15.12.2020, passed by the Special Assistant Agent and SubDivisional Magistrate, Mobile Court, Bhadrachalam, is subsisting as on today.

In view of the same and having regard to the said order, dated 15.12.2020, this Writ Petition is disposed of granting liberty to the petitioner to submit a fresh application to respondent No.3 requesting him to provide police protection/aid, in respect of the aforesaid property, by mentioning the specific date and time. On making such an application, respondent No.3 shall consider the same and provide police protection/aid to the petitioner in respect of the subject property, in accordance with law. Miscellaneous petitions, if any, pending shall stand closed. No costs.
