SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.12242 OF 2011 ORDER:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners - accused Nos.1 to 5, 8 to 13 and 15 & 16 seeking to quash the proceedings in Calendar Case No.111 of 2011 on the file of the learned XIV Metropolitan Magistrate, Cyberabad at L.B. Nagar, registered for the offences punishable under Sections 448, 379, 325, 506, 365, 420 and 500 of the Indian Penal Code, 1860.

2. A private complaint, which was filed by respondent No.2 herein, was referred to the police for investigation, and the police having investigated the case, filed a final report stating that there was lack of evidence. As against the same, respondent No.2 filed a protest petition under Section 190 (1) of the Code, and the learned Magistrate recorded the sworn statement of the respondent No.2 - complainant, and the sworn statement shows that prima facie the allegations made against the petitioners are made out.

3. Hence, considering the above, this Court opines that it is not safe to quash the proceedings against the petitioners at this stage and, accordingly, the present Criminal Petition is dismissed.

Consequently, Miscellaneous Petitions, if any, pending in the present Criminal Petition stand dismissed.
