ORDER:

The proceedings dated 10.02.2008 issued by the 1st respondent under Section 6A of the Essential Commodities Act, is under challenge in this writ petition.

This Court by order dated 19.03.2009 while issuing Rule Nisi, granted interim suspension, as prayed for.

Learned counsel for the respondent submits that on account of non-availability of certain records, enquiry has not been completed. In that view of the matter, no useful purpose would be served by keeping the writ petition pending as the writ petition itself is filed against the suspension pending enquiry.

Considering the fact that the writ petition is of the year 2009, the writ petition is disposed of directing the respondents to complete the enquiry and pass appropriate final orders, if not already passed, in accordance with law as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. However, the order of interim suspension granted by this Court on 19.03.2009 shall continue till the completion of the proceedings initiated under Section 6A of the Act, by the respondent authorities. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
