This petition is filed, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of bail to the petitioner-accused No. 2 in crime No. 79 of 2017 of Rolugunta Police Station, Visakhapatnam District. 2.
Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

Learned counsel for the petitioner submits that the allegation against the petitioner is only that he transported Ganja. Learned Public Prosecutor has opposed the bail petition contending that the petitioner is a habitual offender and his confession itself shows that he transported Ganja, in the similar manner, on three occasions.

Hence, considering the above, this Court is not inclined to grant bail to the petitioner.

The criminal petition is accordingly dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
