This is an appeal by the unsuccessful petitioner/appellant assailing the orders dated 31.12.2007 of the learned X Additional District Judge, Machilipatnam passed in IA.No.878 of 2007 in AS.No.201 of 2007. When the matter is taken up, it is represented that the cause in the appeal no longer survives for adjudication and that the appeal may be dismissed as infructuous.

Recording the submission, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, pending if any, in this appeal shall stand closed.
