THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.6441 of 2019 ORDER:

The prayer of the petitioner - Temple in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents No.2 and 3 in acting upon the request for survey of land to fix boundaries of land of temple situated in Sy.No.1 at Pallecheruv, Mailardevarapally Village, Rajendra Nagar Mandal, R.R. District illegal and unconstitutional and consequently direct the respondent administration to protect the temple land and structures of temple deity if necessary by fencing the temple land being used by devotees in Sy.No.1 at Pallecheruv, Mailardevarapally Village, Rajendra Nagar Mandal, R.R.Dist by demarcating the boundaries and pass such order or orders as this Hon'ble Court deems fit in the interest of justice.'

Perusal of the record reflects that an application in the prescribed format by way of a F-line petition along with the requisite fee was submitted by the petitioner - Temple on 16.03.2019 for undertaking a survey of the subject land.

Having received such an application, it is not open to the Tahsildar, Rajendra Nagar Mandal, Ranga Reddy District, to remain inactive. The writ petition is accordingly disposed of directing the Tahsildar, Rajendra Nagar Mandal, Ranga Reddy District, to take appropriate action upon the petitioner - Temple's F-line petition dated 16.03.2019 expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source. Pending such exercise, the Station House Officer, Mailardevarapally, Rajendra

Nagar Mandal, the fourth respondent herein, shall ensure that status quo is maintained as regards the nature of the subject land.
