This petition is filed under Sections 437 and 439 Cr.P.C. by the petitioner/accused No.2 seeking bail in Crime No.74 2017 on the file of the Station House Officer, Excise Police Station, Balanagar, registered for the offence punishable under Sections 8(c) read with 20(b)(ii) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to him under law including filing of fresh petition. 3.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn granting liberty to the petitioner to avail the remedies available to him under law including filing of fresh petition. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
