Heard Mr.A.V.S.Ramakrishna for petitioners, the Assistant Government Pleader for Co-operation and Mr.Kishore for 4th respondent.

The petitioners pray for the following relief :- " ...... to issue an order or direction, particularly one in the nature of writ of Mandamus directing the respondents to number the claim petition filed by the petitioners herein in E.P.No.527 of 2010-11 in General No 14947 of Award 237/ 0708......" Mr.Kishore, appearing for 4th respondent places, on record the written instructions, dated 17.02.2018. The operative portion of the instructions reads as follows :- " After examination of the claim petition filed by the petitioners, the claim petition is entertained and numbered as 1/ 2017-18 on 15.02.2018 and the hearing of the Claim Petition is posted to 26.02.2018 at 11 AM in the office of the Deputy Registrar/ Officer on Spl Duty, KDCCB Ltd, Machilipatnam. Accordingly notices were issued by the concerned parties.

Meanwhile, the Sale Officer was directed on 15-02-2018 to postpone the sale of properties till the disposal of the claim petition filed by the petitioners. The Asst. Registrar/ Sale Officer, KDCCB Ltd, Machilipatnam published the sale adjournment notice on the Notice Board of the Bantumilli PACS on 16-02-2018.

as the prayer of the petitioners is already conceded. Hence, the W.P. filed by the petitioners is liable for dismissal."
