HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5307 of 2018 Order:

The petitioner claims that he is the absolute owner and possessor of the land of an extent of Ac.17.33 gts., situated in Survey Nos.170/A1, 171/A1, 172/A1, 156/A 2/1, 158/A2, 157/A, 154/A1 of Khammampalli village, Munipalli Mandal, Sanga Reddy District, having purchased the same under a registered sale deed dated 27.03.2017. The Vendor's name was recorded in the revenue records. In view of the same, after purchasing the property, he applied for mutation of his name in the revenue records and for issuance of pattadar passbooks on 23.05.2017 and even after receiving the same when no action was taken, the present Writ Petition was filed.

Learned counsel for the petitioner submits that the fourth respondent issued an endorsement on 11.09.2017 stating that the mutation was not effected in view of Court case pending in Crime No.58 of 2012 and unless final judgment copy is available, the mutation cannot be effected.

But, when the learned Government Pleader was directed to obtain instructions, the fourth respondent issued written instructions on 24.01.2018 stating that Crime No.58 of 2012 was closed as the complainant himself stated that he does not want to proceed with the case. After disposal of the case on 01.11.2017, the petitioner submitted an application and sought for mutation in view of disposal of the said case. While so, one Smt. Priya Arcot and Smt. A.V. Niranjana filed written objections stating that they have purchased the said land in the year 1997 and they have not sold the land to any one. In view of the title dispute,

the parties were asked to appear before him on 16.02.2018 and, in the meanwhile, the present Writ Petition was filed. In view of the action taken by the fourth respondent pursuant to the request made by the petitioner, the fourth respondent is directed to consider the objections as well as the request of the petitioner and pass appropriate orders thereon within a period of three (3) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
