HON'BLE SRI JUSTICE S.V. BHATT CRL.P.No.8299 OF 2017 ORDER:

Heard Mr.E.Venkata Siddarth, holding for Mr.M.A.K.Mukheed, counsel for petitioners and the Assistant Public Prosecutor. The petitioners pray for quashing C.C.No.302 of 2012, on the file of the XIV-Additional Chief Metropolitan Magistrate, Hyderabad. The counsel for petitioners submits that one of the purposes of present petition under Section 482 Cr.P.C is to direct XIV-Additional Chief Metropolitan Magistrate, Hyderabad to complete the trial and dispose of C.C.No.302 of 2012.

The Additional Public Prosecutor after perusing the record and the stage of the matter firstly submits that if the accused are regularly attending the Court, the matter would not have been kept pending for too long and alternatively the Court considers disposing of the criminal petition by directing expeditious disposal of C.C.No.302 of 2012.

I have perused the material on record and taken note of the limited submission of counsel for petitioners. In the case on hand, charge sheet was filed in February, 2012 and the pendency of trial, having regard to the totality of circumstances, needs to be taken note of.

Hence, the criminal petition is disposed of by directing learned XIV-Additional Chief Metropolitan Magistrate, Hyderabad to dispose of C.C.No.302 of 2012 within four months from the date of

receipt of a copy of this order. The petitioners are given liberty to file a memo by enclosing a copy of this order before the learned XIV-Additional Chief Metropolitan Magistrate for necessary action and further undertake to remain present on all the dates of hearing.
