This Writ Petition was filed challenging the action of the respondents in not initiating any action against the illegal constructions made in Pheelkhana, Begum Bazar, Gynanbagh Colony, opposite to Begum Bazar LMG School, opposite to Ravi Petrol Pum, Goshamahal School and Fish Market, Aghapura. The petitioner states that he is a resident of Gowliguda and noticed illegal constructions while moving around the said area. He submitted representations on 11.11.2011, 25.11.2011 and 06.03.2012 to the official respondents and when no action was taken, the present Writ Petition was filed. The representation dated 11.11.2011 filed along with the Writ Petition contain the details of the house numbers where the alleged unauthorized constructions were taking place. The said representation was followed by reminders dated 25.11.2011 and 06.03.2012. When such representations were received by the respondents, they should have acted in accordance with law.
In the circumstances, the Writ Petition is disposed of directing the second respondent to whom a representation was made on 11.11.2011, giving the details of the places where the unauthorized constructions were being made, to depute responsible officers and take necessary action on the unauthorized constructions in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. It is needless to observe that if any action is proposed to be taken against the
unauthorized constructions the affected parties should be given due notice. There shall be no order as to costs. The Miscellaneous Petitions pending, if any, shall stand closed.
