THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.13173 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to direct the respondents to consider the regularization of the services of the petitioners in the light of G.O.Ms.No.16, dated 26-02-2016 in the post of Work Inspector in the 2nd respondent corporation pursuant to the representation, dated 14-03-2016 made by the petitioners."
Heard Sri.V.CH. Naidu, learned counsel for the petitioners, learned Government Pleader for Housing Corporation for respondent No.1 and Sri C. Buchi Reddy, learned Standing Counsel for respondents 2 and 3.
The case of the petitioners herein is that they have been working in the respondents' corporation for the last more than 23 years as Work Inspectors. It is their further case that the State Government issued an order vide G.O.Ms.No.16 Finance (HRM.I) Department, dated 26-02-2016 and according to the same, the petitioners are entitled for regularization. Paragraph No.3 of the said G.O. reads as under:
"3. Accordingly, the following Notification will be published in an issue of the Telangana State Gazette. Regularization may be considered only in respect of eligible personnel working as on 2nd June, 2014, immediately before formation of Telangana State, and continuing till the date of proposed regularization."
It is further stated that seeking benefit under the above said G.O. the petitioners herein submitted a representation, dated 1403-2016 to the 2nd respondent and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioners herein to direct the 2nd respondent to take appropriate action on the representation, dated 14-03-2016, in accordance with law, by fixing some timeframe. It is submitted by learned Standing Counsel for respondents' corporation that the said representation said to have been submitted by the petitioners would be considered, in accordance with law.
Recording the said submission, the writ petition is disposed of, directing the 2nd respondent to consider and pass appropriate orders on the representation, dated 14-03-2016 said to have been submitted by the petitioners herein, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
