THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13107 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners/accused Nos.4 and 5 in C.C.No.382 of 2015 on the file of IV Additional Judicial Magistrate of First Class Court, Chittoor. 2 At the time of arguments, the learned counsel for the petitioners sought permission of the Court to permit the petitioners to withdraw this Criminal Petition, with liberty to avail the remedies available to them under law, including filing of petition for discharge. He further requested the Court to dispense with the presence of the petitioners before the trial Court on each and every date of adjournment. 3 Permission is accorded. There is no dispute with regard to the identity of the petitioners, who are A4 and A.5 in C.C.No.382 of 2015. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the 2nd respondent.
4. In the result, the Criminal petition is dismissed, granting the liberty as prayed for, dispensing with the presence of the petitioners, who are accused Nos.4 and 5 in C.C.No.382 of 2015 on the file of the Court of the IV Additional Judicial Magistrate of First Class, Chittoor, on each and every date of adjournment. However, the petitioners shall appear before the trial Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
