THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.55 OF 2015 ORDER:
This Criminal Revision Case is filed against order, dated 23.12.2014, passed by the IV Metropolitan Magistrate, Ibrahimpatnam, Ranga Reddy District, in Crl.M.P. No.2395 of 2014 in Crime No.481 of 2014.
The brief facts of the case are that on 20.12.2014 at 19.15 hours, the SubInspector of Police, Ibrahimpatnam went to Mangalpally Gate and stopped one DCM (Eicher) Van bearing No.AP 16 Y 6868, which was proceeding towards Hyderabad in suspicious circumstances and checked the same and found 13 bulls cruelly tied with ropes. After completing the panchanama, the police seized the cattle. Heard and perused the material available on record. Learned counsel for the petitioner submitted that he is a genuine purchaser of the cattle and he purchased the said cattle for his Diary Form and detention of the cattle would cause irreparable loss to him. He further submitted that the petitioner filed Crl.M.P. 2395 of 2014 before the IV Metropolitan Magistrate for release of cattle, but the same was dismissed.
Learned Additional Public Prosecutor also submitted that interim custody of the cattle can be granted to the petitioner by imposing certain conditions. Considering these circumstances, it is directed that the cattle (13 Bulls), shall be released for interim custody of the petitioner, subject to final orders to be passed at the time of disposal of main case, on his executing a personal bond for Rs.1,30,000/- (Rupees one lakh and thirty thousand only). Further the petitioner shall undertake to produce the cattle as and when required by the Court.
Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J June 08, 2015.
