THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Appeal Suit no.686 of 1995 JUDGMENT:

The unsuccessful defendants 5 to 9 preferred this appeal suit, under Section 96 of the Code of Civil Procedure, 1908, assailing the decree and judgment, dated 29.03.1995, of the learned Subordinate Judge, Razole, passed in OS.No.2 of 1982.

On 01.11.2018, when this appeal suit was taken up for hearing, Sri S. Subba Reddy, learned counsel, who formerly appeared for the appellants-defendants 5 to 9, submitted that the appellants have taken away the case record along with no objection vakalath and, therefore, he is no longer appearing for the appellants. Therefore, the Registry was directed to list the matter today, 08.11.2018, by printing the names of the appellants.

Today, when the appeal is taken up for hearing, Smt. Y. Maha Lakshmi, learned counsel, submitted that she filed vakalath for the appellants, vide USR.No.91740 of 2018. The appellants are also present. Sri K.V. Subrahmanya Narsu, learned counsel appearing for the respondents 6 & 7, is also present. Respondents 6 & 7 are the legal representatives of the deceased 1st respondent-sole plaintiff. The said learned counsel stated that the matter is settled outside the Court and, therefore, no further orders are necessary in this appeal suit.

Recording the submissions, the appeal suit is dismissed as adjusted out of Court. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. _______________________ M. SEETHARAMA MURTI, J 08.11.2018 Vjl
