Sri Brahmachary Muth, v. The Commissioner
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION NO.6442 OF 2012 ORDER:
1.
This Writ Petition is filed by the petitioner seeking to declare the action of respondents Nos.1, 2, 4 and 5 in not restraining respondent No.6 and his agents from proceeding with the illegal constructions in the land covered by Sy.Nos.339 to 344 situated at Attapur Village, Rajendrnagar Mandal, Ranga Reddy District, as illegal and arbitrary, and consequently, to direct the above official respondents to stop the 6th respondent and his agents from proceeding with the construction activity in the above said land, and to demolish the illegal constructions already made. 2.
Heard and perused the material available on record. 3.
The main grievance of the petitioner is that the 6th respondent and his agents are making illegal constructions over the subject land without any manner of right over the same and that the petitioner has given a representation to respondents Nos.1, 2, 4 and 5 to take necessary action against the 6th respondent and his agents, and to restrain them from making any illegal constructions in the subject land. But respondents Nos.1, 2, 4 and 5 have not taken any action so far on his representation. 4.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: "Respondents Nos.1, 2, 4 and 5 are directed to consider the representation of the petitioner dated 14.2.2012 and take appropriate action in accordance with law."
5.
With the above direction, the Writ Petition is disposed of. No costs. Miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Dated: 10.3.2017.
