This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused No. 3 in Crime No. 76 of 2017 of Rolugunta Police Station, Visakhapatnam District, registered for the offences punishable under Section 8 (c) read with Section 20 (b) (ii) (c) and Section 25 of NDPS Act. 2.
The case of the prosecution is that accused Nos. 1 and 2 approached this petitioner for procuring Ganja. Hence, the facts of the case do not entitle the petitioner for anticipatory bail. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Court below having jurisdiction. The Court below shall dispose of the bail application, if any filed, on merits expeditiously, preferably on the same day, subject to pressure of other work. 3.
Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
