LK,J Learned counsel for the petitioners submits that the respondent Corporation has rejected the building permission on the ground that the major part of the plot area is getting affected under proposed 100'.0' wide slip road as per RDP. Learned counsel has relied on the order dated 12-09-2016 in W.P.No.42282 of 2015, wherein this Court has held that since mere indication in the master plan that a portion of the land is required for public purpose would not deprive the ownership of the petitioners and in such situation, proposals of this nature should be initiated by the land acquisition authority.

Learned Standing Counsel submits that though the respondent Corporation is ready to act under TS-bPASS Act, the petitioners are not ready to accept the same and then, they have issued proceedings under land acquisition.

In response to the same, learned counsel for the petitioners submits that the respondent Corporation has not stated about the said proceedings under land acquisition in the counter filed by them. Learned Standing Counsel submits that the respondent Corporation will come up with additional counter affidavit in this regard.
