ORDER
This writ petition is filed as a sequel to the final order passed by a Division Bench of this Court in W.A.No.1036 of 2017, dated 27.07.2017.
The petitioner was running petroleum outlet under licence issued by the authorities. The said licence was suspended by the 2nd respondent-Joint Collector, Chittoor, dated 22.06.2017, pending further enquiry relating to the cancellation of licence. Challenging the said order, the petitioner filed W.P.No.20961 of 2017 and this Court by order dated 12.07.2017 allowed the writ petition and directed the Joint Collector to issue a show cause notice for cancellation before proceeding with the enquiry. Against the said order, the 4th respondent in the said writ petition preferred W.A.No.1036 of 2017 and a Division Bench of this Court while setting aside the order of the learned Single Judge granted suspension of the order dated 22.06.2017 passed by the Joint Collector, pending final orders to be passed by him after giving all the parties to the proceedings an opportunity of being heard. Now, the enquiry is pending before the 2nd respondent. In the meantime, it appears that the 2nd respondent displayed a Board
stating that the petrol bunk is under seizure and no transactions have been taking place. In those circumstances, the present writ petition is filed.
When the Division Bench granted suspension of the order passed by the 2nd respondent, the latter ought not to have seized the petrol bunk.
Learned Standing Counsel appearing for the 3rd respondent submits that they are supplying petroleum products to the petitioner, but in view of prevention by the 2nd respondent, the petitioner is not in a position to run the petrol bunk. In the circumstances, there shall be a direction to the 2nd respondent not to interfere with the business of the petitioner till final order is passed by him in the pending proceedings. It is needless to observe that the petitioner and respondents 3 & 4 shall co-operate for disposal of the proceedings before the 2nd respondent.
