HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.27280 OF 2009 ORDER:

When the matter is taken up for hearing, learned counsel on either side fairly concede that the issue involved in this writ petition is squarely covered by the order dated 11.04.2011 passed by this Court in C.M.A.Nos.1042 and 1043 of 2006.

Following the order dated 11.04.2011 passed by this Court in C.M.A.Nos.1042 and 1043 of 2006, this Writ Petition is allowed by setting aside the impugned order and the conveyance allowance payable to the employees of the petitioner should be excluded from the purview of 'wages' as defined under Section 2(22) of the E.S.I. Act. No order as to costs.
